These Terms of Use ("Terms") govern your access to and use of volundrlab.com (the "Site"), operated by Volundr Labs, LLC, an Arizona limited liability company ("Volundr Labs," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Informational purposes only
The Site describes our services for general information. Nothing on the Site is an offer, a quotation, a guarantee of results, or professional advice. Any engagement with Volundr Labs is governed solely by a separate written agreement signed by both parties.
2. No client relationship or confidentiality from the Site
Submitting a message through the Site does not create a client, consulting, or confidential relationship. Please do not send confidential, proprietary, or sensitive information through the contact form until a written agreement addressing confidentiality is in place.
3. Acceptable use
You agree not to: use the Site unlawfully or to infringe the rights of others; attempt to gain unauthorized access to the Site, its servers, or related systems; interfere with or disrupt the Site or its security; introduce malware; scrape or harvest the Site by automated means in a way that burdens it; or submit false, misleading, or abusive content through the contact form.
4. Intellectual property
The Site and its content, including text, graphics, logos, the Volundr Labs name and marks, and design, are owned by or licensed to Volundr Labs or its affiliates and are protected by intellectual property laws. You may view the Site and share links to it for personal or internal business evaluation. You may not copy, modify, distribute, or create derivative works from the Site's content without our prior written permission. All rights not expressly granted are reserved.
5. Your submissions
If you send us a message, you grant us a limited license to use it to respond to you, evaluate a potential engagement, and operate our business as described in our Privacy Policy. You are responsible for ensuring you have the right to share the content you submit.
6. Third-party links
The Site may link to third-party websites, including websites of our affiliates. We do not control and are not responsible for third-party sites, and a link is not an endorsement. Their terms and privacy policies apply when you use them.
7. Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Volundr Labs and its affiliates, members, managers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Volundr Labs and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
10. Changes
We may modify the Site or these Terms at any time. The "Effective" date above shows when the Terms last changed. Continued use after changes means you accept the updated Terms.
11. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
